California voters approved Proposition 31 in November 2022 (effective Dec 21, 2022), prohibiting retail sale of most flavored tobacco products. The law applies broadly to nicotine pouches in flavors other than tobacco/unflavored. Tobacco-flavor pouches and unflavored options remain legal at retail.
Online sale rules
Online sale of flavored nicotine pouches to California addresses is widely restricted by retailers in line with state law. Tobacco-flavor and unflavored variants are typically still shipped.

Federal baseline (applies in every state)
Two federal laws set the floor nationwide and apply in California:
- Tobacco 21 Act (2019) — minimum age 21 for the sale of all tobacco and nicotine products, including nicotine pouches, with no state-level grandfathering exceptions.
- PACT Act of 2009 — regulates mail-order tobacco and nicotine products. Online retailers must verify buyer age, require adult signature on delivery, and register with the ATF and applicable state tax authorities.
- FDA marketing authorization (PMTA) — separate from state legality, the FDA requires PMTA review of nicotine pouch products. As of May 2026, all 20 ZYN SKUs and 6 on! PLUS SKUs are authorized; most other brands have applications pending or not submitted.
Where to legally buy nicotine pouches in California
- Licensed tobacco retailers and convenience stores with valid state tobacco licenses
- Major online retailers that verify age and require adult signature on delivery (e.g., established nicotine pouch sellers, manufacturer direct-to-consumer sites)
- Important for California: only tobacco-flavored or unflavored pouches are typically available at retail and online; flavored variants are restricted.
